Chandigarh: A significant dialogue on legal and social issues concerning men was held in Chandigarh on 30 August. The Ekam Nyaay Foundation organised the Ekam Nyaay Dialogue at Law Bhawan, Bar Council of Punjab & Haryana, Chandigarh.

 Balancing Justice: Protecting the Innocent While Empowering the Vulnerable
 
 
 

Dr. Ashok Kumar Mittal, Member of Parliament, Rajya Sabha and Justice Rajesh Bindal, Former Judge of the Supreme Court of India joined the conference as Chief Guests and Justice MM Kumar, former Chief Justice of Jammu & Kashmir High Court was the Guest of Honour. Justice Ritu Bahri, Former Judge Punjab & Haryana High Court, Sh. Sanjeev Jindal, Former Additional District & Sessions Judge, Sr. Advocate Anil Malhotra, Sr Advocate Kshitij Sharma, Dr. Nidhi Sharma, UILS, Seema Gupta Mittal Psychologist, Activist Anmol Dang, Journalist Dipcy Sagoo also joined the conference along with several eminent speakers.

Speaking at the conference, Dr. Ashok Kumar Mittal said “Pain does not have Gender, Crime does not have Gender then why should laws and justice have a Gender” emphasizing the need for a platform for men when their grievances can be heard. He spoke about the private member bill he presented for establishing National Commission for Men in India in Rajya Sabha. While lauding the efforts of Ekam Nyaay Foundation, Dr. Mittal said that NGOs working on issues of men are filling a gap in the society and also providing data on issues men are facing.

Justice Rajesh Bindal delivered the keynote address on the central theme of the conference, “Balancing Justice: Protecting the Innocent While Empowering the Vulnerable.” He said “There is a Ministry for Women, Ministry for Children, Commission for Women, Commission for Children, there is senior citizens Act but we certainly don’t have a platform for men. It is appreciable that a private member bill for National Commission for Men has been moved by Member of Parliament Dr. Ashok Mittal. The Constitution of our nation says Equality before law, Equal rights for all but if it is true today. Ekam Nyaay Foundation is doing a great job in bringing issues men are facing to light. They are gathering data which is very important because that helps in understanding the severity of the problem. In my tenure I have questioned misuse and abuse of laws and tried to balance both sides. There are many rape cases being filed today over financial disputes, relationship disputes and it trivialises seriousness of law, at the same time there are many instances where genuine victims who are women, don’t file cases. I want to emphasise the importance of meditation too, there should be pre – litigation mediation in matrimonial disputes except offences like dowry death. There are victims of crime and there are victims of process, men who suffer because of false allegations and suffer in legal process for years and decades are victims of process as it takes them years to clear their name. What they lose cannot be given back to them. We require change in mindset, people shouldn’t think of becoming enemies and be hell bent on putting the other party in Jail. Ekam Nyaay Foundation is doing a very good job and the panel discussions today have very relevant subjects. Maybe one day we will have laws that help everyone.

Deepika Narayan Bhardwaj, journalist, documentary filmmaker and Founder-Director of the Ekam Nyaay Foundation, said “We feel honoured that so many distinguished speakers came to the Ekam Nyaay Dialogue, Chandigarh, and shared their views, and I believe that it was a meaningful dialogue on extremely important issues affecting society today. A progressive and healthy society is one where every gender’s voice is heard and everyone is treated equally. Men being victims is also a social reality today, and our endeavour is to take the discussions on these issues beyond court judgments and make them a part of public discourse.

The programme also saw the release of the “Husband Murder By Wife and Suicide Report.
According to the Ekam Nyaay Foundation, the organisation has documented more than 2,000 cases of murders and suicides of men related to adultery, false allegations and matrimonial harassment over the past three years.
